TRIBAL ATTORNEY
CHEYENNE RIVER SIOUX TRIBE

The Cheyenne River Sioux Tribal Attorney shall have the following credentials and/or qualifications:
1. He/she shall be a graduate of an American Bar Association accredited law school. Preference in hiring shall be given to members of the Cheyenne River
Sioux Tribe and members of other federally recognized Indian tribes/nations,
according to prevailing tribal policy. The Tribe is an equal opportunity employer with Native American preference. Tribal members are strongly encouraged to apply.
2. He/She shall be eligible for admission or admitted to the practice of law in South
Dakota and to the practice of law in the Cheyenne River Sioux Tribal courts.
Alternately, he/she shall be eligible to take the next South Dakota Bar Examination scheduled when the Tribal Attorney commences his/her duties as Tribal Attorney. He/She shall also apply to the Tribal Court for admission within five (5) business days after assuming office, if he or she is not already admitted to the practice of law in the Tribal courts.
3. He/She must be a law school graduate, with a minimum of three (3) years experience performing complex litigation for federally recognized Indian tribes/nations and/or organizations seeking to protect the rights of Native Americans and federal recognized Indian nations and/or tribes is preferred. Judicial internships or clerkships may also be included within the assessment of experience.
4. He/She shall be or must become thoroughly familiar with: the 1868 Treaty,
(15 Stat. 635), the Constitution and By-Laws of the Cheyenne River Sioux Tribe, as amended , the Tribal Law and Order Code, the Indian Civil Rights Act, 25 U.S.C. section 1301 et. seq., Tribal criminal and civil procedures, the Major Crimes Act, 18 U.S.C. section 1153 et seq., relevant federal Indian law cases with emphasis on cases decided by the United States Supreme Court and the U.S. Eighth Circuit Court of Appeals, the common law of the Cheyenne River Sioux Tribe, Tribal history and culture, SDCL section 1-1-25 (South Dakota’s comity statute) and the cases decided thereunder, State v. Larsen, 455 N.W. 2d 600 (1990) and other relevant materials relating to the role and function of a Tribal Attorney, whether assigned or unassigned.
5. It shall be the duty of the Attorney to act as Attorney for the Tribe under the direction and supervision of the Tribal Council, and to represent the Tribe before courts, departments, tribunals, committees of Congress and other offices in legal matters referred to him/her by the Tribal Council. In addition, the Tribal Attorney shall perform other duties as assigned. The Tribal Attorney shall perform such services on a 40-hour per week basis, excluding weekends, holidays, vacation days, sick days or other authorized leave days and he/she shall regularly report to the Tribal Council in regard to matters referred to the Tribal Attorney.
6. The Tribal Attorney shall have the ability to work well with others in a culturally diverse environment – experience in dealing with Native Americans is preferred – in a culturally appropriate manner.
7. The Tribal Attorney shall be paid an annual salary, depending on experience and qualifications, and shall be entitled to the same employment benefits as other Tribal employees (i.e., annual/sick leave; annuity; vision and dental insurance; health insurance).
8. The Tribal Attorney shall be entitled to use regular leave time in such personal and other matters with prior notification to the Tribal Chairman, provided, however, that his/her use of such leave shall not adversely affect departmental schedules or operations, nor shall such activity conducted during leave be in conflict with or interfere with his/her representation of the Tribe.
9. The Tribal Attorney shall receive, or not receive, raises in salary at the same time and the same percentage as Tribal employees in general, pending availability of funds.
10. A Tribal house shall be allocated for the Tribal Attorney on the same terms as other Tribal officials and employees.
11. The Tribal Attorney shall be advanced or reimbursed for travel expenses incurred in the representation of the Tribe in the same manner as Tribal employees in general.
